Rape

Rape is the use of force or other means to force someone to undergo acts that (partly) consist of sexual intrusion into the body. It concerns any intrusion of the body with a sexual intent. There must be violence or threat of violence, but one can also think of psychological pressure on the victim. If you or someone close to you is suspected of rape, it is important to call in an expert lawyer. The lawyers at our firm have a great deal of experience in handling criminal cases, including moral cases. Please contact us for assistance and advice.

Rape is punishable under Article 242 of the Penal Code. The legal text can be found below:

Article 242
Any person who, by force or other fact or threat of force or other fact, forces a person to undergo acts consisting of, or in part consisting of, the sexual intrusion of the body shall be liable to a term of imprisonment not exceeding twelve years or a fifth category fine for rape.

Penalty for rape

Many people wonder what punishment someone can expect for rape, but that question can never be answered just like that. Punishment is tailor-made. In the case of a conviction, the judge looks at all kinds of factors, such as the circumstances under which the offence was committed, the person of the suspect, the maximum sentence and judgments in similar cases. The lawyers at our firm can make a realistic assessment of a possible penalty, even if it is ultimately up to the court to make the decision.
