Threat

Threat is the threat of (in most cases) physical violence or death against a person, their relatives or property. Threats are punishable under section 285 of the Penal Code. The legal text can be found below:

 

Article 285
1. Threats of openly associating violence against persons or property, of violence against an internationally protected person or his protected property, of any crime which endangers the general safety of persons or property or creates a common danger for the provision of services, of rape, of actual assault on honour, of any crime against life, of hostage-taking, of aggravated assault or of arson shall be punishable by terms of imprisonment not exceeding two years or a fourth category fine.
2. If this threat is made in writing and subject to certain conditions, it shall be punishable by up to four years' imprisonment or a fourth-category fine.
3. The threat of a terrorist offence shall be punishable by up to six years' imprisonment or a fifth-category fine.
4. If the offence described in paragraphs 1, 2 or 3 is committed with the intention of preparing or facilitating a terrorist offence, the imprisonment imposed on the offence shall be increased by a third.

 

Punishment for threat

Many people wonder what punishment someone can expect for a threat, but that question can never be answered just like that. Punishment is tailor-made.
