Skimming
Skimming is illegally obtaining and copying payment card data. It is a form of payment card fraud in which the magnetic strip of a card is copied and the PIN code is obtained when a payment transaction is made. A copy of the card is then made. Together with the PIN, money can then be withdrawn and paid for at home and abroad. If you or someone in your area is suspected of skimming, it is important to call in an expert lawyer. Skimming is punishable by Article 232 of the Penal Code. The legal text can be found below:
Article 232
1. Any person who intentionally forges or falsifies a payment card, a value card, any other card available to the public or a carrier of identity data available to the public for the purpose of making or obtaining payments or other automated payment services, with a view to obtaining an advantage for himself or for another person, shall be liable to a term of imprisonment not exceeding six years or a fifth category fine.
2. The same penalty shall be imposed on any person who intentionally uses the counterfeit or falsified card or pass as if it were genuine and genuine, or intentionally issues, holds, receives, procures, transports, sells or transfers such a card or pass, knowing or reasonably suspecting that the card or pass is intended for such use.
