Heling

Healing is the deliberate purchase, possession or transfer of a good when one knows that the good originates from a crime committed by another. Healing is punishable in art. 416 of the Penal Code. The legal text can be found below:

 

Article 416
If guilty of wilful intent, the penalty shall be imprisonment for a term not exceeding four years or a fifth-category fine:
a. he who acquires, holds or transfers an asset, or creates or transfers a personal right to or a right in rem in respect of an asset, whereas at the time of the acquisition or the holding of the asset or the establishment of the right, he knew that the asset was acquired by crime;
b. he who, for the purpose of profit, intentionally possesses or transfers property derived from crime, or transfers a personal right or right in rem in respect of property derived from crime.
2. The same penalty shall be imposed on any person who intentionally takes advantage of the proceeds of any property obtained by crime.
