Fraud is punishable in art. 326 of the Penal Code. The legal text can be found below:

Article 326
1. He who, with the intent to give himself or another person unlawful advantage, either by assuming a false name or by a false capacity, or by sly manoeuvres, or by a conspiracy of compaction, induces a person to deliver any good, to provide a service, to make data available, to incur a debt or to extinguish a debt, shall be liable to a term of imprisonment not exceeding four years or a fifth-category fine.
2. If the offence is committed with a view to preparing or facilitating a terrorist offence, the imprisonment imposed on the offence shall be increased by one third.

Penalty for fraud

Many people wonder what punishment someone can expect for scams, but that question can never be answered just like that. Punishment is tailor-made. In the case of a conviction, the judge looks at all kinds of factors, such as the circumstances under which the offence was committed, the person of the suspect, the maximum sentence and judgments in similar cases. The lawyers at our firm can make a realistic assessment of a possible penalty, even if it is ultimately up to the court to make the decision.
