Discrimination

Discrimination is the unequal treatment of people because of certain characteristics such as origin, sex, skin colour, sexual preference, age, religion, disability or chronic illness. If you or someone in your area is suspected of discrimination, it is important to call in an expert lawyer. The lawyers at our firm have a great deal of experience in handling criminal cases, including discrimination cases. Please contact us for assistance and advice.

Discrimination is punishable in art. 137d of the Penal Code. You will find the legal text below:

Article 137d
1. Any person who, in public, orally or by written or pictorial means, incites hatred of or discrimination against persons or violence against persons or property of persons on account of their race, religion or belief, gender, heterosexual or homosexual orientation or physical, mental or intellectual disability shall be liable to a term of imprisonment not exceeding one year or to a third category fine.
2. If the offence is committed by a person who makes a profession or habit of it or by two or more persons acting in concert, a term of imprisonment not exceeding two years or a fourth-category fine shall be imposed.

Penalty for Discrimination

Many people wonder what punishment someone can expect for discrimination, but that question can never be answered just like that. Punishment is tailor-made. In the case of a conviction, the judge looks at all kinds of factors, such as the circumstances under which the offence was committed, the person of the suspect, the maximum sentence and judgments in similar cases. The lawyers at our firm can make a realistic assessment of a possible penalty, even if it is ultimately up to the court to make the decision.
