What punishments can a judge impose?

On 10, Aug 2012 | In Frequently Asked Questions | By - K. Canatan

In the event of a conviction, the judge has the following options:
- imprisonment (or in case of offences: detention)
- community service; this may consist of community service or learning.
- financial penalty

In the last two possibilities, the judge determines that if the accused does not comply with the sentence imposed, alternative detention will take place. For all possible punishments, a judge may also impose them (in whole or in part) on a conditional basis. This means that the sentence will only be executed if a suspect is again guilty of an offence or has not complied with another condition set by the judge during a probationary period of usually 2 years.

In addition to the above penalties, the judge may impose so-called additional penalties. These include disqualification from certain rights, forfeiture (of objects that are related to the offence) and publication of the court judgment.
